Many tenants who have been served with an eviction lawsuit just need more time to move out. While it may be possible for the tenant to defeat the eviction lawsuit, it may not be cost-effective to do so, given the costs of hiring an attorney compared to the common lease provision that limits the attorney’s fees a prevailing party in a lawsuit may recover from the losing party to around $1,000, meaning that a tenant who wins a lawsuit would not be able to recover more than $1,000 in attorney’s fees from the landlord. In some circumstances when we believe we could provide cost-effective representation for the tenant, we defend tenants from evictions, especially when the tenant just needs some more time to find a new home. If we don’t feel we can provide cost-effective representation, we provide advice to the tenants about how to defend themselves in eviction court.
